About this visa

A Partner (Provisional) visa (subclass 309/100) is for clients who want to travel and live in Australia and are spouse and de facto partners of:

  • an Australian citizen
  • an Australian permanent resident
  • an eligible New Zealand citizen

A Prospective Marriage visa (subclass 300) is for clients who want to come to Australia to marry their prospective spouse who is:

  • an Australian citizen
  • an Australian permanent resident
  • an eligible New Zealand citizen

Prospective Marriage visa (subclass 300) is a temporary resident visa valid for nine months. The marriage can take place in Australia or any other country.

Before you apply

The following is information you should be aware of before you lodge your visa application.

  • For both visas, the applicant must be outside Australia when the visa application is lodged and when the visa is granted.
  • Health examination and police certificates have a validity period. If they are not valid at time of visa grant, those who have completed and submitted the health examination and police certificate will be requested again.
  • Once the visa is granted, you will be required to make your first entry to Australia by a certain date known as the “initial entry date.” 
    • The initial entry date will appear in the letter you receive from the department advising you of your visa grant. 
    • The date is determined based on the validity of any health and police checks you have provided as part of the process of applying for a Partner category visa (and your intended marriage date if you are a Prospective Marriage (subclass 300) visa applicant). 
    • The initial entry date cannot be changed after your Partner category visa is granted. If you do not enter Australia before the initial entry date, your visa may be cancelled unless exceptional and compelling circumstances can be proven.

 

How do I apply for the visa?

Partner category visa application can be lodged online or by paper. For both online and paper visa application, the applicant and sponsor must each complete an application form, provide supporting documents and pay a visa application charge.
